California Applicant Privacy Notice

Custom Truck One Source, Inc., its affiliates, and related entities (the “Company,” “us,” “our,” or “we”) collects, uses, discloses, and otherwise processes the Personal Information of California job applicants and other individuals in connection with our recruitment and hiring activities (“Applicants”) pursuant to the California Consumer Privacy Act (“CCPA”). This Applicant Privacy Policy discloses our privacy practices related to the collection, use, and disclosure of Personal Information collected.

Unless otherwise noted, the disclosures herein describe our current practices, as well as our practices in the preceding twelve (12) months.

Applicant Personal Information Collection.

We collect information about Applicants that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with an Applicant, such as a name, postal address, email address, telephone number, and/or payment information (“Personal Information”). Personal Information includes sensitive Personal Information, but does not include publicly available, deidentified, or aggregated information. We collect Personal Information when you participate in the recruitment process; automatically when you use our websites; from vendors that help us operate our business, including human resources and information technology; from internet sources, including social media and other websites; and from other sources, including people you have named as your references, previous employers, schools, public authorities, recruiters or recruitment services, or public resources. The types of Personal Information we collect depend on the nature of interactions with us and may include:

  • Identifiers and personal records, including name, alias, postal address, unique personal identifier, online identifier, IP address, email address, account name, and other similar identifiers.
  • Personal Information described in Cal. Civ. Code § 1798.80(e), including name, signature, address, telephone number, education, employment, or employment history. We may also collect sensitive Personal Information, including information concerning health. Some of these pieces of information may overlap with other categories.
  • Characteristics of protected classifications under California or federal law, including gender, work authorization status, and veteran status. We also may collect sensitive Personal Information, including racial and ethnic origin, citizenship or immigration status, gender identity, medical condition, and disability status.
  • Internet or other electronic network activity information, including device information, such as IP address, device identifier, browser information, operating system, language information; browsing history; search history; and information regarding interaction with websites, device data, or social media account information, URL accessed, and dates and times of activity.
  • Geolocation information, including as derived from an IP address.
  • Professional or employment-related information, including education; work history; certificates and degrees obtained; languages spoken and skills; professional memberships; former positions; resume and cover letter information; education information, including schools attended and performance records; information contained in documents and other resources you choose to share with us; information obtained from references; and background check information (to the extent permitted, and in accordance with applicable law).
  • Inferences from Personal Information collected, including customer profiles reflecting preferences and predispositions.

Applicant Personal Information Use.

We or our vendors may use your Personal Information for:

  • Recruiting and hiring activities, including opening and maintaining records; recommending roles that may be appropriate to your background and interests; making hiring decisions, and including assessing qualifications and carrying out interviews.
  • Human resources activities, including communicating with you; and administering workforce planning and staffing.
  • Community and engagement activities, including managing hiring events and programs.
  • Technology and security purposes, including facilitating access to and use of our technology resources; improving our technology resources; managing the security of our premises and systems; and preventing, investigating, identifying, or taking other actions regarding suspected or actual fraudulent or illegal activity, or any activity that violates or may violate applicable laws, regulations, or legal process, or our policies.
  • Complying with and administering legal obligations, including fulfilling work authorization, identity verification, immigration, audit, health, safety, employment, and other legal requirements; providing reasonable accommodations; complying with applicable laws, regulations, legal process, or company policies; and preventing, investigating, identifying, or taking other action regarding legal claims, compliance, regulatory, and investigative activities.

Applicant Personal Information Disclosure.

We may disclose Personal Information that we collect or you provide as described in this policy or in one of the following circumstances:

  • Company entities for managing recruiting and hiring activities and other business operations.
  • Vendors, consultants, service providers, and other business providers for conducting recruiting and hiring activities; managing technology resources; complying with applicable laws and employment-related requirements; performing verification and background check activities; and otherwise supporting our business.
  • Insurers and professional advisers for managing risks, obtaining professional advice, and exercising or defending against legal claims.
  • Law enforcement agencies, professional advisors, courts, regulators, and other government agencies to comply with reporting obligations (including anti‐discrimination laws); legal processes (including court orders, subpoenas); or other legal requirements of any governmental authority, in connection with threatened or actual litigation, to protect our legal rights or property, to protect the legal rights or property or physical security of others, or for the prevention or detection of crime.
  • Parties to corporate transactions, including acquiring or acquired entities, as part of a corporate transaction or proceeding, including a merger, financing, acquisition, bankruptcy, or dissolution, or at transfer, divestiture, or sale of all or a portion of a business or assets.

Retention of Applicant Personal Information.

We keep the categories of Personal Information described above for as long as is necessary for the purposes described in this Applicant Privacy Notice or otherwise authorized by law. This generally means holding the information for as long as one of the following apply:

  • The Personal Information is reasonably necessary to manage our operations, to manage your relationship with us, or to satisfy another purpose for which we collected the Personal Information.
  • The Personal Information is reasonably necessary to carry out a disclosed purpose that is reasonably compatible with the context in which the Personal Information was collected.
  • The Personal Information is reasonably required to protect or defend our rights or property.
  • We are otherwise required or permitted to keep the Personal Information by applicable laws or regulations.

Where Personal Information is used for more than one purpose, we will retain it until the purpose with the latest period expires.

Applicant Privacy Rights.

As California residents, Applicants have the following privacy rights related to Personal Information:

Rights to Confirm, Access, and Know. You may have the right to confirm whether we are processing your Personal Information, to know what Personal Information we have collected about you, to obtain certain details about the Personal Information we process about you, and to access your Personal Information.

Right to Correct. You may have the right to request that we correct inaccuracies in your Personal Information.

Right to Delete. You have the right to request that we delete your Personal Information, subject to certain exceptions.

We do not sell Applicant Personal Information or share Applicant Personal Information for cross-context behavioral advertising, so we do not offer a way to submit such a request. We do not use or disclose sensitive Personal Information for purposes to which the right to limit use and disclosure applies under the CCPA, so we do not offer a way to submit such a request.

We will not discriminate or retaliate against you if you choose to exercise any of your privacy rights.
